1. Acceptance of Terms

By accessing our website, booking expeditions, or utilizing any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These Terms constitute a legally binding agreement between you and RealmSeekers.

We reserve the right to modify these Terms at any time without prior notice. Your continued use of our services following any changes constitutes your acceptance of the revised Terms.

2. Expedition Bookings and Payments

All expedition bookings are subject to availability and acceptance by RealmSeekers. A booking is not confirmed until you receive written confirmation from us and the required deposit has been paid.

Deposit requirements:

• A non-refundable deposit of 25% of the total expedition cost is required to secure your booking.
• The remaining balance is due 60 days prior to the expedition start date.
• For bookings made within 60 days of the expedition start date, full payment is required at the time of booking.

We accept payments via credit card, bank transfer, and other methods specified during the booking process. All prices are quoted in Australian Dollars (AUD) unless otherwise specified.

3. Cancellations and Refunds

Cancellation by you:

• More than 60 days before departure: Loss of deposit only.
• 60-30 days before departure: 50% of total expedition cost.
• Less than 30 days before departure: 100% of total expedition cost.

We strongly recommend purchasing comprehensive travel insurance that includes cancellation coverage.

Cancellation by RealmSeekers:

We reserve the right to cancel any expedition due to insufficient participation, force majeure, or safety concerns. In such cases, you will receive a full refund of all payments made to RealmSeekers for that expedition, or you may choose to transfer to another available expedition. RealmSeekers is not responsible for any additional expenses incurred in preparing for the expedition (e.g., airline tickets, accommodation, gear purchases).

4. Health and Fitness Requirements

Participants must be in good physical and mental health to join our expeditions. You are responsible for assessing whether an expedition is suitable for your abilities and health condition.

You must disclose any pre-existing medical conditions, allergies, or dietary requirements at the time of booking. Failure to disclose relevant health information may result in removal from the expedition without refund.

RealmSeekers reserves the right to refuse participation to anyone whose health or fitness level is deemed inadequate for the expedition's demands, or whose participation might endanger themselves or others.

5. Assumption of Risk

Adventure travel and expeditions involve inherent risks. By booking with RealmSeekers, you acknowledge and accept these risks. You agree that neither RealmSeekers nor its staff, guides, partners, or affiliates will be liable for any injury, illness, death, or property damage resulting from participation in our expeditions.

You will be required to sign a liability waiver before participating in any RealmSeekers expedition. Parents or legal guardians must sign for participants under 18 years of age.

6. Travel Documents and Insurance

You are responsible for obtaining all necessary travel documents, including valid passports, visas, and permits. RealmSeekers is not liable for any issues arising from inadequate documentation.

Comprehensive travel insurance is mandatory for all expedition participants. Your insurance must cover emergency evacuation, medical treatment, trip cancellation, and loss or damage to personal belongings. Proof of insurance must be provided prior to the expedition start date.

7. Intellectual Property

All content on the RealmSeekers website, including text, graphics, logos, images, audio clips, and software, is the property of RealmSeekers and is protected by Australian and international copyright laws.

You may not reproduce, distribute, modify, display, or create derivative works from any content without our explicit written permission.

8. Media Release

RealmSeekers may photograph, film, or record expeditions for promotional, educational, or commercial purposes. By participating in our expeditions, you grant RealmSeekers permission to use your image, likeness, and statements in photographs, videos, or recordings without compensation.

If you prefer not to be included in such materials, please notify us in writing before the expedition begins.

9. Privacy Policy

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
